Under the Texas Workers’ Compensation system, Death Income Benefits (or DIBs) can help replace a portion of the lost wages for beneficiaries after the death of a loved one. These types of benefits are calculated as 75% of the deceased worker’s average weekly wage and are paid by the workers’ compensation insurance carrier. You must file a Notice of Fatal Injury or Occupational Disease and Claim for Compensation for Death Benefits (DWC Form-042) within one year of the date of death.

DIBs are available for the following eligible parties:

  • Surviving spouse of the deceased injured worker by formal law or common law marriage
  • Dependent child or children
  • Dependent grandchild or grandchildren
  • Other dependent family members, including grandparents, parents, or siblings
  • Non-dependent parents when there are no surviving dependent family members or eligible spouse

For the surviving spouse, DIBs are provided until remarriage, at which point a lump sum payment of 104 weeks of death benefits is provided. DIBs are supplied for dependent children under the age of 18 and discontinue when they reach the age of 18. If they become enrolled full-time at an accredited higher education institution, however, they are eligible to continue receiving DIBs until the age of 25. If there is no surviving spouse or dependent family members, then DIBs are provided for non-dependent parents for 104 weeks, or two years.
