What is the Adoption Process?

Due to the legal complexities involved, it is important to have someone on your side who fully understands the adoption process. At Recalde Law Firm, PLLC, we have the necessary knowledge and skill to guide you from the very beginning of your case.

The adoption process is as follows:

  • Termination of paternal rights of biological parents
  • Home study
  • Amicus attorney or attorney ad litem
  • Final adoption

Termination of Paternal Rights of Biological Parents
Before a child can be adopted, if the biological parents are still alive, one or both of the biological parents must have their parental rights terminated.

Home Study
This is a study conducted by a social worker to provide information to the court about the prospective adoptive parents. A home study includes an interview of the adopting parents, reference letters from family and friends, financial information, criminal history background check, child abuse background check, and verification of legal documents.

Amicus Attorney or Attorney Ad Litem
When an adoption is done, the court will appoint an amicus attorney or an attorney ad litem to make sure that the adoption is in the best interest of the child or children. The amicus attorney or attorney ad litem will visit with the child and the adoptive parents in order to make their assessment.

Final Adoption
After the termination of parental rights has been achieved and all required paperwork has been filed, the court will set a time to hear the case and finalize the adoptions.
